Dell Incentives Lawsuit Dismissed by North Carolina State Court

RALEIGH, N.C. (May 11, 2006) -- The case challenged the legality of the incentives package North Carolina offered to Dell to build its new assembly plant in Winston-Salem.

The Wall Street Journal reports that a state court judge has thrown out the lawsuit challenging the $300 million incentives package the state of North Carolina offered in order to convince the company to build its newest assembly plant in North Carolina.

Wake County Superior Court Judge Robert Hobgood tossed out the case filed by seven North Carolina taxpayers and backed by the non-profit North Carolina Institute for Constitutional Law (NCICL), a non-profit organization. The judge found that NCICL failed to show how the Dell deal directly hurts the interests of the North Carolina residents.

Another important case (Cuno vs. DaimlerChrysler, Inc) challenging the authority of states to offer financial incentives is currently before the U.S. Supreme Court. The Court heard arguments earlier this year and is expected to render its decision in early June.
